The following  are the sequence of events in brief of the so-called constitutional crisis going-on in Pakistan (as reported also at https://www.dawn.com/news/1683715/where-are-nsc-meetings-minutes-cjp-asks-babar-awan ) :-

[The weeks-long political turmoil in Pakistan reached its climax on April 3 after the National Assembly (NA) Deputy Speaker prorogued the NA without allowing voting on a no-confidence motion against PM Imran. The Dy. Speaker who was chairing the session (because Speaker was not available due to no-confidence motion against him), dismissed the motion, terming it against Article 5 of the Constitution which the Law Minister referred to, reiterating PM Imran’s earlier claims that a foreign conspiracy (of the USA). was behind the move to oust the government and also said that the NSC meeting wanted strong action against the USA as mentioned at https://pmo.gov.pk/press_release_detailes.php?pr_id=4073 hence de-marches were issued against the USA as mentioned at https://mofa.gov.pk/follow-up-of-the-meeting-of-the-national-security-committee/ .

With the result Dy Speaker dismissed the no-confidence motion, ruling that it was contradictory to the law, the Constitution and the rules. After this Imran, in an address to the nation, said he had advised the president to dissolve assemblies and also congratulated the nation for the no-trust motion being dismissed, saying the Dy Speaker had rejected the attempt of changing the regime and the foreign conspiracy. Imran further said he had advised the President to dissolve the assemblies, adding that the democrats should go to the public and elections should be held so the people could decide who they wanted in power. Subsequently, the President dissolved the NA under Article 58 of the Constitution and allowed Imran to remain PM till the appointment of caretaker Prime Minister to get elections of NA conducted].

 

Whatever may be the verdict of the Supreme Court of Pakistan (SCP) over this controversy, it warrants a response from Prez Biden (in the interest of protecting the global political order which the USA, through the UN,  sponsored as the leader of the free world) as given below:-

 

(1)- Russia, through the Ukraine war, has given a major blow to global political order which has already harmed the image of the USA immensely, as the leader of the free world. Hence Prez Biden should not remain silent over this political and constitutional crisis in Pakistan which has been triggered by alleged interference of the USA in the internal (political) matters of Pakistan.

 

(2)- Notwithstanding whatever is appearing in national (US & Pakistan) and international media against Imran, Biden should understand that the stand taken by Imran is not as against the laws and practices of a democratic country as is being projected. Even in the largest functioning democracy of the world, India (Pak’s neighboring country) the Members of Parliament get disqualified if they commit certain offenses (and not merely floor crossing / so-called horse-trading disallowed by anti-defection laws).

 

(3)- In Pakistan the situation is specially different due to its constitution’s Article 5 (regarding loyalty to State) and Article 6 (regarding high-treason which is not even reviewable by higher judiciary). Hence if the MNAs (even majority of the NA who brought no-confidence motion) committed offense under any law or the constitution of Pakistan which has a potential of disqualifying them, then the Dy Speaker was perfectly within his right to quash / hold the no-confidence motion till these charges are thoroughly investigated with a verdict by legally competent authority. Till then the President had every right to dismiss the NA on the advice of the PM Imran (who like any PM in a democracy enjoyed the majority in the NA because there was not any no-confidence motion pending against him) and also to dissolve the NA and order fresh elections.

 

(4)- But there is a catch in this situation which Biden should take into consideration. Biden must have been informed by his official sources that Imran has succeed to great extent to create an impression among the considerable part of general public in Pakistan that – “the opposition (which brought no-confidence motion) were not only corrupt (as Imran has been saying publicly since he assumed office) hence NAB cases are against leaders of major opposition parties but now they are also playing in the hands of the USA to destroy the independence & sovereignty of Pakistan hence they (opposition which brought no-confidence motion due to conspiracy by the USA) are traitors too”.

 

(5)- Biden must be knowing that in the said impression created in substantial part of Pakistan by Imran, three factors are helping Imran –  (i)- Even if SCP gives verdict that Imran’s charge against USA of conspiracy to dislodge Imran (because Imran is pursuing independent foreign policy) are not substantiated and bogus, these people in Pakistan will not believe PCB due to lack of credibility of PCB (which was demolished even by major opposition party PML-N and by national & international media which accused PCB of dislodging Nawaz Sharif from Prime Minister office in ‘judicial coup’ (ii)- Nowadays (especially after 9/11 when the USA went militarily  in Afghanistan & Iraq) Muslims are prepared to believe anything (right or wrong) against the USA (iii)- The official public support of China and Russia for Imran against the USA in this controversy, are also not helping the Biden-administration

 

(6)- Therefore now the USA has only one option available which is to move the ‘International Court of Justice’(ICJ). The ICJ may entertain the legal disputes between States submitted to it by them (contentious cases) as mentioned at https://www.icj-cij.org/en/how-the-court-works . The ICJ may easily decide whether the USA really intervened in internal matters of Pakistan which is against international laws of the UN or Pakistan is leveling unsubstantiated charges against the USA. Only such a verdict of the ICJ will clear the name of the USA from the on-going controversy in Pakistan (a nuclear country of 220 million people and which has been trying to establish democracy since 2008 after many years of periodic military rule).

 

It is hoped Prez Biden will take the global political order seriously especially in this age of cold war -II between ‘liberal Western democracy’ against ‘authoritarian Chinese democracy’ and will take the help of the ‘International Court of Justice’ which only will clear the name of the USA effectively and credibly from the political dirt which is being raised (related to the USA) in Pakistan
